Is it legal to sell used socks in the UK? The honest 2026 answer

The UK legal position on selling used socks and underwear — HMRC tax rules, DAC7 platform reporting, age verification and where real prosecution risk actually sits.

"Is this actually legal?" is the first question almost every new UK seller asks — usually after seeing a TikTok that either dramatically overstates the risk or hand-waves it away. Neither is accurate. The honest 2026 answer is simple: yes, it's legal, provided you handle tax and age verification the same way any other UK sole trader would.

The short version

Selling used clothing between consenting adults is legal in the UK. There is no criminal offence, no regulated licence and no product-safety scheme that applies to worn socks, underwear or leggings. The Consumer Rights Act still governs the transaction (item as described, satisfactory quality), and standard HMRC tax rules kick in once you clear the £1,000 trading allowance.

That's the whole legal picture. Every scare story you've seen collapses down to one of three things: tax evasion, age-verification failure, or off-platform fraud. All three are handled by using a verified UK platform and declaring your income like any other sole trader.

The £1,000 HMRC trading allowance

Every UK adult has a £1,000 tax-free trading allowance per tax year (6 April – 5 April). Under £1,000 gross across all your self-employment: nothing to file. Over £1,000: register for Self Assessment, file a return each January, pay Income Tax and Class 2/4 National Insurance on the profit (not the gross).

Register at gov.uk/register-for-self-assessment. Keep monthly platform payout statements and receipts for anything you legitimately deduct — packaging, postage, a portion of your phone bill if you use it for the business.

DAC7 marketplace reporting — assume you're visible

From January 2024, digital platforms operating in the UK must report seller information to HMRC once you cross 30 transactions or roughly £1,700 in a calendar year. That's the OECD DAC7 framework applied by HMRC. The platform sends your name, address, tax reference and total payouts.

The practical takeaway: never assume payouts are invisible. Declare everything above £1,000 and you have absolutely nothing to worry about. Trying to hide income under the reporting threshold is the single most common way sellers get themselves into real trouble — and it's the one thing HMRC finds trivially easy to catch.

Age verification — the one non-negotiable

Selling anything with sexual content to a minor is a criminal offence in the UK. Every reputable marketplace requires ID-verified 18+ status on both sides for exactly that reason. Never accept off-platform contact from anyone whose age you haven't verified, and block/report immediately if someone contacts you claiming to be underage or refusing verification.

Where prosecution risk actually sits

  • Fraud: taking payment and never shipping is theft, prosecutable.
  • Tax evasion: not declaring income above £1,000 is a criminal offence with escalating penalties.
  • Off-platform payment: bank transfer or PayPal friends & family bypasses buyer protection and platform DAC7 reporting — flags for both HMRC and the marketplace.
  • Photo theft: reusing another seller's photos is copyright infringement and gets accounts terminated fast.

What is not illegal, despite what you'll read

  • Selling worn socks, underwear or leggings between adults.
  • Trading under a stage name (as long as your HMRC and bank details are real).
  • Accepting subscription buyers.
  • Custom requests, provided both parties are 18+ and the request is lawful.

The compliance checklist

  1. Register for Self Assessment once you clear £1,000 gross in a tax year.
  2. Keep monthly payout statements from your platform.
  3. Keep receipts for packaging and postage.
  4. Only sell via ID-verified platforms with in-platform checkout.
  5. Never accept off-platform payment.
  6. Never send to anyone who won't confirm 18+ verification.
